Terms of Service

The terms governing your use of Trident Inspection Group services and this website.

These Terms of Service (“Terms”) govern your use of tridentinspectiongroup.com and the inspection services provided by Trident Inspection Group (“Trident,” “we,” “our,” or “us”).

By engaging us to provide inspection services or by using our website, you agree to these Terms.

1. Acceptance of terms

By scheduling an inspection, accepting our pre-inspection agreement, paying our invoice, or otherwise engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of services

Trident provides residential and commercial property inspections, sewer scope inspections, mold and indoor air quality testing, chimney inspections, termite inspections, pest control, wildfire mitigation inspections, aging-in-place assessments, and related services. Specific scope is set forth in your pre-inspection agreement.

3. Scope of inspection

Unless otherwise expressly stated in your pre-inspection agreement, Trident inspections are visual, non-invasive evaluations of readily accessible systems and components performed in accordance with the applicable Standards of Practice (InterNACHI for residential, ASTM E2018 for commercial Property Condition Assessments, IAC2 for mold testing, NFPA 211 for chimney, and California Structural Pest Control Board Section 1900 et seq. for termite).

Inspections do not include items concealed by walls, finishes, insulation, or stored items, nor do they include code compliance, engineering analysis, environmental hazards beyond the specified scope, or any condition that cannot reasonably be observed at the time of inspection.

4. Report use and licensing

The inspection report is prepared exclusively for the named client and may not be transferred, assigned, or relied upon by any third party without our prior written consent. The report reflects conditions observed at the date and time of inspection and may not reflect conditions before or after that time.

5. Scheduling and cancellation

Inspection appointments are scheduled by mutual agreement. Cancellations or rescheduling requested at least 24 hours before the scheduled appointment incur no fee. Cancellations or rescheduling within 24 hours may incur a mobilization fee of up to $150.

6. Fees and payment

Fees are quoted in advance and are due at the time of inspection unless otherwise agreed in writing. Reports may be withheld pending payment. Past-due balances accrue interest at 1% per month or the maximum rate permitted by California law, whichever is lower.

7. Client obligations

You agree to provide accurate information about the property, ensure access to all areas to be inspected (including utilities being on, pilot lights lit, and access to attic, crawl space, and electrical panels), and to inform us of any known defects or hazardous conditions before the inspection.

8. Disclaimers and warranties

The inspection is not a warranty, guarantee, insurance policy, or substitute for any disclosure required by law. Trident does not warrant that any system or component will perform for any particular period, will be free of latent defects, or will comply with any specific code, regulation, or standard. To the fullest extent permitted by law, all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, are disclaimed.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRIDENT'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE INSPECTION OR THESE TERMS SHALL NOT EXCEED THE FEE PAID FOR THE INSPECTION.

Trident shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost opportunity, or diminution in property value, regardless of the theory of liability.

10. Indemnification

You agree to indemnify and hold harmless Trident, its officers, employees, and agents from and against any and all third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your unauthorized distribution of the inspection report.

11. Intellectual property

All content on this website — including text, graphics, logos, photographs, and report templates — is the property of Trident or its licensors and is protected by United States and international copyright laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

12. Third-party services

Our website and reports may include links to or content from third parties (e.g., mapping services, payment processors). We are not responsible for the availability, accuracy, or content of those third-party services.

13. Termination

We may suspend or terminate services at any time for any reason, including for non-payment, breach of these Terms, or unsafe inspection conditions. Termination does not relieve you of obligations accrued before termination.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

15. Dispute resolution

Any dispute arising out of or relating to these Terms or our inspection services shall be resolved exclusively by binding arbitration administered by JAMS in Orange County, California, under the JAMS Streamlined Arbitration Rules. Each party waives the right to a trial by jury and the right to participate in any class or representative action.

Notwithstanding the foregoing, either party may bring an individual claim in small-claims court for matters within that court's jurisdiction.

16. Changes to these terms

We may update these Terms from time to time. Material changes will be posted prominently on the website. Continued use of our website or services after revisions constitutes acceptance of the updated Terms.
